Terms of Service

1. Acceptance of Terms

By accessing, registering on, or using the Tekkivo platform ("Platform") at tekkivo.com, you ("User", "you") agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms in their entirety, you must immediately cease all use of the Platform. These Terms constitute a legally binding agreement between you and Tekkivo TI Pvt Ltd ("Tekkivo", "we", "us"). We reserve the right to modify these Terms at any time. Continued use after modifications constitutes acceptance.

2. Eligibility

You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that: (a) you are at least 18 years old; (b) you have the legal capacity to enter into binding contracts; (c) your use of the Platform does not violate any applicable law in your jurisdiction; (d) you are not located in a jurisdiction where forex trading or financial services are prohibited. Users from certain jurisdictions including but not limited to the United States (for certain regulated activities), Iran, North Korea, and other OFAC-sanctioned countries may be restricted from certain features.

3. Description of Services

Tekkivo provides: (a) AI-powered forex trading signals and analysis; (b) educational content, articles, and financial guides; (c) financial calculators and tools; (d) a complete automated trading bot system available for one-time purchase; (e) a monthly subscription service for ongoing signal access; (f) a TI Studio investment pool participation program. All services are provided for informational and educational purposes only. Nothing on this Platform constitutes financial advice, investment advice, or a recommendation to buy or sell any financial instrument.

4. Account Registration & Security

You must provide accurate, current, and complete information when creating an account. You are solely responsible for: (a) maintaining the confidentiality of your login credentials; (b) all activities that occur under your account; (c) notifying us immediately of any unauthorized access at dev@tekkivo.com. We reserve the right to suspend or terminate accounts with inaccurate information, suspected fraudulent activity, or violations of these Terms. You may not create multiple accounts, share accounts, or transfer accounts to third parties.

5. Subscriptions & Pricing

Monthly Subscription: $40 USD per month, billed in advance on a recurring basis. The subscription provides access to AI trading signals, dashboard features, and platform content. Subscriptions renew automatically unless cancelled. You may cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period. Complete Bot System: A one-time purchase providing a lifetime commercial license to the trading bot software. Pricing is as displayed on the Platform at the time of purchase. Tekkivo reserves the right to change pricing at any time with 14 days' notice for subscription changes. Price changes do not affect existing active subscriptions until renewal.

6. STRICT NO-REFUND POLICY

ALL PAYMENTS MADE TO TEKKIVO ARE STRICTLY AND UNCONDITIONALLY NON-REFUNDABLE. By completing any payment, you expressly and irrevocably agree that: (a) All subscription fees, one-time purchase fees, and any other charges are final and non-refundable under any circumstances. (b) No refunds will be issued for unused subscription periods, partial months, or any portion of a subscription term. (c) No refunds will be issued for the Complete Bot System or any digital product purchase, regardless of whether the product has been downloaded, accessed, or used. (d) No refunds will be issued due to dissatisfaction with trading results, signal performance, or market conditions. (e) Initiating a chargeback, payment dispute, or reversal through PayPal or your financial institution without prior written authorization from Tekkivo constitutes a material breach of these Terms and may result in: immediate permanent account termination; legal action to recover the disputed amount plus damages, legal fees, and costs; reporting to credit agencies where applicable. (f) If you believe a charge was made in error (e.g., duplicate charge), you must contact legal@tekkivo.com within 7 days of the transaction with supporting evidence. We will investigate and respond within 10 business days.

7. Advertising & Promotions

The Platform displays third-party advertisements through Google AdSense and other advertising networks. By using the Platform, you acknowledge and agree that: (a) Tekkivo may display advertisements on any page of the Platform; (b) the nature, frequency, and placement of advertisements are at Tekkivo's sole discretion; (c) Tekkivo is not responsible for the content, accuracy, or legality of third-party advertisements; (d) clicking on advertisements may direct you to third-party websites governed by their own terms and privacy policies; (e) Tekkivo may receive compensation from advertisers based on impressions, clicks, or conversions. Tekkivo may also run promotional campaigns, discount offers, and limited-time pricing. Promotional pricing is subject to change without notice and cannot be applied retroactively to existing purchases.

8. Trading Risk Disclaimer

TRADING FOREX, CRYPTOCURRENCIES, AND OTHER FINANCIAL INSTRUMENTS INVOLVES SUBSTANTIAL RISK OF LOSS AND IS NOT SUITABLE FOR ALL INVESTORS. You acknowledge and agree that: (a) past performance of any trading signal, strategy, or bot is not indicative of future results; (b) you may lose some or all of your invested capital; (c) leverage can work against you as well as for you; (d) Tekkivo's signals, analysis, and tools are for informational and educational purposes only and do not constitute financial advice; (e) you are solely responsible for your own trading decisions; (f) you should seek independent financial advice before making any investment decisions; (g) Tekkivo is not a licensed financial advisor, broker, or investment manager in any jurisdiction.

9. Intellectual Property

All content on the Platform including but not limited to text, graphics, logos, software, algorithms, and trading signals is the exclusive property of Tekkivo TI Pvt Ltd and is protected by applicable intellectual property laws. Upon purchase of the Complete Bot System, you receive a non-exclusive, non-transferable, lifetime commercial license to use and modify the software for your own trading purposes. You may NOT: (a) resell, sublicense, or distribute the original or minimally modified source code as a competing product; (b) claim authorship or ownership of the software; (c) use Tekkivo's trademarks, logos, or brand assets without prior written consent; (d) scrape, copy, or reproduce Platform content for commercial purposes.

10. Prohibited Conduct

• Using the Platform for any unlawful purpose or in violation of any applicable law.
• Attempting to gain unauthorized access to any part of the Platform or its infrastructure.
• Transmitting malware, viruses, or any harmful code.
• Engaging in market manipulation, front-running, or any form of financial fraud.
• Creating fake accounts, using bots to access the Platform, or circumventing access controls.
• Sharing your account credentials with third parties.
• Reverse engineering, decompiling, or disassembling any part of the Platform.
• Using the Platform to harass, defame, or harm other users.
• Violating any third-party rights including intellectual property rights.

Violation of any prohibited conduct may result in immediate account termination without refund and may subject you to civil and/or criminal liability.

11. TI Studio Investment Pool

Participation in the TI Studio investment pool is subject to additional terms disclosed at the time of participation. Investment pool participation involves financial risk. Returns are not guaranteed. Tekkivo does not guarantee any specific return on investment. Participation fees and invested amounts are subject to the no-refund policy in Section 6.

12. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE. We do not warrant that: (a) the Platform will be error-free or uninterrupted; (b) trading signals will be accurate or profitable; (c) the Platform will meet your specific requirements; (d) any defects will be corrected. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEKKIVO TI PVT LTD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR: (a) any trading losses, investment losses, or financial damages arising from use of the Platform; (b) any indirect, incidental, special, consequential, or punitive damages; (c) loss of profits, revenue, data, or business opportunities; (d) damages resulting from unauthorized access to your account; (e) any damages exceeding the total amount you paid to Tekkivo in the 12 months preceding the claim. This limitation applies regardless of the theory of liability (contract, tort, negligence, or otherwise) and even if Tekkivo has been advised of the possibility of such damages.

14. Indemnification

You agree to indemnify, defend, and hold harmless Tekkivo TI Pvt Ltd and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; (d) any trading decisions made based on Platform content; (e) any content you submit to the Platform.

15. Termination

Tekkivo reserves the right to suspend or permanently terminate your account and access to the Platform at any time, with or without notice, for any reason including but not limited to violation of these Terms, fraudulent activity, or non-payment. Upon termination: (a) your right to access the Platform ceases immediately; (b) no refunds will be issued for any remaining subscription period; (c) provisions of these Terms that by their nature should survive termination shall survive. You may terminate your account at any time by contacting legal@tekkivo.com. Termination does not relieve you of any payment obligations.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Platform shall be resolved as follows: (a) First, through good-faith negotiation between the parties; (b) If unresolved within 30 days, through binding arbitration conducted in accordance with applicable arbitration rules; (c) Arbitration shall be conducted in English and the seat of arbitration shall be India. Notwithstanding the foregoing, Tekkivo reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered users and/or a prominent notice on the Platform at least 14 days before taking effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and may request account deletion.
